In providing a multifaceted service to customers, all personal data we collect from users and site visitors, such as personal data include name, email address, personal account preferences, transaction data, such as purchase information and technical data, such as information about cookies.

We do not collect or store sensitive data concerning health, nor do we enquire as to any other kind of sensitive information.

The reasons we collect data comply to given rules and regulations and are done legally to provide you with our services. For purely operational purposes, L I T E R A T I  M A G A Z I N E  utilises Jetpack on WordPress. This collates visitor clicks and visits as well as general geo-location markers. No individual data is collected. Social media referrals are also noted.  By default WordPress does not collect any analytics data.

What we share with others

As a visitor, contributor or participant on the Literati Magazine website on this WordPress platform, information and data is shared with selected plug-in providers who help us provide our orders and store services to you; for example, PayPal, WooCommerce, Akismit, Jetpack – Vaultpress. This could include, but may not be limited to analytics, payment gateways, shipping providers and the occasional third party embed. None of these occur without your consent. We do not share your data for third party marketing purposes.


How we protect your data

Aside from conforming to Swiss legal data protection encryption requirements, we use Jetpack powered Vaultpress, a real-time backup and security-scanning tool.

What data breach procedures we have in place

In the case of any security breaches, we fully collaborate with WordPress to solve any issues and we undertake to inform our users and customers immediately as to the nature and status of any such breaches.


We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.

General Terms and Conditions of Business

1.  Applicability

1.1.  These General Terms of Business (‘Terms’) govern the relationships between Rare Swan Press (‚Rare Swan‘) and its Customers.

1.2.  These Terms apply in the version that is current at the time the Contact of Sale is concluded.

1.3.  These Terms may be supplemented or varied by Rare Swan through a written document that refers expressly to these Terms.

2. The Contract of Sale

2.1.  Display of the goods does not represent an offer to conclude a contract with the Customer.

2.2.  The Customer may submit an order by email. The order qualifies as a binding offer to conclude a Contract of Sale.

2.3.  Literati Magazine will send a confirmation of receipt of the order by email. This confirmation does not represent an acceptance of the offer; it is to inform the Customer that the order has been received.

2.4.  A Contact of Sale comes into being when Literati Magazine accepts the Customer’s offer by either sending the ordered goods to the Customer or confirming the goods have been sent.

2.5.  If Literati Magazine is unable for whatever reason to accept the Customer’s offer, the Customer will be informed of the unavailability of the goods, respectively, rejection of the offer.

2.6.  Where the goods are temporarily unavailable, Rare Swan will inform the Customer and, unless otherwise informed by an email from Literati Magazine, the order shall remain valid as an offer until such time as it is accepted in accordance with section 2.4.

2.7.  The Customer will be promptly informed of any incorrect details regarding the goods and, here possible, offered an alternative.

2.8.  Literati Magazine is entitled to provide part-performance and part-invoicing.

(a)  Where part-delivery is made, Rare Swan shall assume any additional costs of delivery;

(b)  Where delivery is delayed, the Customer will be informed.

3. Price, Payment Terms and Delivery

3.1.  Prices may vary. Unless otherwise notified to the Customer in writing, the price at the time the order is submitted is applicable.

3.2.  Prices are quoted either in Swiss francs (CHF) or Euros (EUR) and include any VAT required by Swiss law.

3.3.  The Customer is solely responsible for payment of any additional costs (e.g. customs and import taxes) imposed by local law or regulation.

3.4.  Literati Magazine only accepts the payment methods displayed on its website at the time of the order.

3.5.  The purchase price and any delivery costs are due when the Contact of Sale is concluded in accordance with section 2.4.

3.6.  Literati Magazine can without giving reasons demand payment in advance, in which case the order will be processed following receipt of payment.

3.7.  The Customer is only entitled to set off payment against money owed in the case of an undisputed sum and only when it relates to the same Contact of Sale.

3.8.  Literati Magazine may charge the Customer late payment interest of 5% per annum for any delay in payment. The right to claim additional compensation for costs incurred enforcing payment remains unaffected.

3.9.  Without prejudice to section 4 below, the Customer shall bear any additional costs, including the costs of return delivery, in the event of rejected delivery unless the delivered goods do not correspond to those ordered.

4. Withdrawal

4.1.  Literati Magazine grants the Customer the right to withdraw from the Contact of Sale without giving any reason within 14 days of receipt of the goods.

4.2.  Customer shall inform Literati Magazine in writing of the withdrawal by email to:    C O N T A C T

4.3.  The consequence of an effective withdrawal is that both parties must return any performance already received:

(i)  Literati Magazine shall refund all payments received from Customer for the goods purchased on the earlier of:

(a)  receipt by Literati Magazine of the undamaged goods; or

(b)  valid evidence from the Customer that it has returned the goods.

(ii)  The Customer shall return the goods in the same state that they were sent to it. In the event of any damage to the goods, the Customer shall compensate Literati Magazine for the loss in value.

4.4.  The Customer shall bear the costs and risk of return unless the delivered goods do not correspond to those ordered.

5. Guarantee

5.1.  Where the delivery is damaged, incorrect or incomplete, (a ‘faulty delivery’), Literati Magazine may at its discretion provide a replacement or cancel the purchase and reimburse the Customer.

5.2.  In the case of faulty delivery Literati Magazine shall bear the costs of delivery.

5.3.  The right of the Customer to bring a claim under the guarantee lapses if the faulty delivery is not communicated to Rare Swan by email to C O N T A C T within 14 days of receipt of the goods.

6. Limitation of Liability

6.1.  Subject to section 6.2 all liability of Literati Magazine for any loss caused to the Customer in connection with the Contract of Sale, on whatever legal principle liability of Literati Magazine might be based, no matter whether the damage is caused by Literati Magazine or an employee, representative or auxiliary of Literati Magazine, shall in no event exceed a maximum of the value of the order.

6.2.  The exclusion of liability in section 6.1 shall not apply to loss caused by the intentional misconduct or gross negligence of Literati Magazine or its employees, representatives or auxiliaries.

6.3.  This limitation of liability may also be relied on by any employees, representatives and auxiliaries of Literati Magazine.

7. Data Protection

7.1.  Literati Magazine shall take appropriate technical and organizational measures to protect Customer data against unauthorized processing and accidental destruction or loss.

7.2.  Details of how Literati Magazine processes data of the Customer can be found in the Privacy and Data Protection Policy.

7.3.  By using the services, Customer agrees that Literati Magazine may use Customer’s personal data for the purposes referred to in the Privacy and Data Protection Policy.

8. Governing Law and Jurisdiction

8.1.  These General Terms of Business and the Contact of Sale are subject to and governed by Swiss law to the exclusion of Swiss International Private Law and any International Treaties.

8.2.  To the extent, the Customer is purchasing for a business any dispute arising from or under these General Terms of Business or the Contact of Sale shall be subject to the exclusive jurisdiction of the competent courts of the Canton of Zug, Switzerland In all other cases jurisdiction for any dispute is in accordance with Art. 32 of the Swiss Civil Procedure Ordinance (ZPO).

Literati Magazine is a provider of editorial and publishing services and goods – specifically falling into the books and magazines categories. Other merchandising or showcasing business generated through the Literati or Rare Swan Press websites as well as editorial and book development services are managed independently of this web shop. Some Rare Swan titles were listed on the Germany based ‘VLB – Verzeichnis Liefbarer Bucher’ offered by MVB Marketing- und Verlagsservicedes Buchhandels GmbH (Index of Deliverable Books), Braubachstrasse 16, 60311 Frankfurt am Main.

The charges listed on the web shop at the time of your order apply unless otherwise notified to you.
